(Bay News 9) -- Georgia police have charged a 12-year-old Tampa boy with murder, but he is so young that he cannot be tried as an adult.
According to Bay News 9's partner paper, the St. Petersburg Times, even with felony murder and cruelty charges, the boy will not face any more than two years in a juvenile facility.
The boy is accused of killing his 5-week-old cousin in Marietta, Ga. The newborn's mother left the two together in the car. When she returned, the baby wasn't moving.
Autopsy results show the baby died from head injuries.
Georgia police are not releasing any of the names of those involved.
Under Georgia law, a parent can leave their child with another child, as long as the parent is comfortable doing so.
