Thursday was day two of testimony in the trial of Trevor Dooley, the man accused of gunning down a father after a confrontation on a basketball court.

Michael Whitt called 911 that September 2010 day. He testified he was playing tennis when the argument happened between David James and Trevor Dooley.

Whitt said Dooley pulled out his gun and the argument led to gunfire.

“They struggled and it went off,” he testified.

Dooley stood next to Whitt and David James’ body when the 911 call was made. The gun was still in his pocket. Whitt wasn't the only witness. James’ daughter watched it all too.

“She was highly distraught, withdrawn and it seems to me in extreme fear,” said Det. Thomas Dirks.

Det. Thomas Dirks said they waited a day to interview the little girl but it was her testimony that led to Dooley's arrest.

The girl wasn't with her mom in court but is expected to testify later this week.

A commonly used anti-depressant was found in James’ body at the time of his death. A forensic toxicologist testified that the prescription drug would have no impact on what led to that deadly shooting.
