A Bay area family has filed a lawsuit against a hospital after they said a nurse cut off part of their baby's pinky finger.

In the lawsuit, the family alleges that a nurse with the Heart of Florida Regional Medical Center in Davenport cut the finger off their 3-month-old baby girl, Selena, while removing an IV.

The family said the hospital hasn't taken any responsibility for the act. 

According to the lawsuit, the child was brought to the hospital in October 2011 for bronchiolitis and respiratory distress.

Two days after being admitted, a nurse cut the child's left hand with a pair of scissors, according to lawsuit.

The baby's mother, Veronica Olguin said she was sitting in the room when the mistake happened.

"I just lay down and everything comes to my mind of what happened,'' said Olguin. "I just see all the blood again, all squirting all over the place and I cry. And she (Selena) cries at night. I think she remembers what happened and cry at night sometimes."

Richards H. Ford, an attorney with Wicker Smith, said the hospital is deeply concerned about the incident in a statement released to the media:

"An unfortunate accident occurred at our hospital while an experienced nurse was removing bandages from the tip of a child’s finger. We rushed the child to a hand specialist, but unfortunately the tip of the finger could not be reattached.

We deeply regret the harm to the child and want to reiterate our compassion and concern for her and her family.

We reached out right away to the child’s family and their attorney, but have not been able to reach a mutually agreeable resolution. We want to reiterate our compassion and concern for the child and her family."

Attorneys with the Pendas Law Firm of Tampa, representing Olguin, said they have tried to work something out with the hospital but that has not yielded results.
