There will be another trial for Cortnee Brantley after her first one ended in a mistrial.

The U.S. Attorney's Office released the following statement this morning:

Pursuant to this Court’s inquiry, following the declaration of a mistrial in this case, the United States informs the court of its intent to pursue its prosecution and to retry the defendant at such time as the court deems appropriate.

Around 1 p.m. Wednesday, the jury told the judge they were having trouble coming to an agreement. The judge ordered them to continue deliberating until an agreement was reached. The mistrial was declared a few hours later.

Brantley is the girlfriend of the man prosecutors say killed Tampa police officers David Curtis and Jeffrey Kocab during a June 2010 traffic stop. She is being tried on a federal charge of failing to tell police Dontae Morris was a felon in possession of a gun and ammunition.

Brantley's attorney has argued that because she had been the subject of a criminal investigation, she had the right to refuse to answer investigators questions.

Still, prosecutors say in not reporting what she knew about boyfriend Dontae Morris, she may have helped him elude arrest.

Also, she left the shooting scene in her car, a key piece of evidence. And she was in contact with Morris after the shooting, officials said.

During Tuesday's testimony, jurors were shown dash cam video of the shooting.

Even if Brantley was found not guilty, she faced state charges of not reporting a felony. She faced the same charge in October 2010 but it didn't stick.

A U.S. appeals court forced the case back to federal court in Tampa in February.

Brantley faced three years in prison if convicted of Misprision of a Felony.
