A driver who received a ticket for running a red light is now challenging the legality of Brooksville's red light cameras.

According to Bay News 9's partner newspaper, The Tampa Bay Times, Julio Carral's attorney said the law allowing the new technology is faulty.

The lawyer said privately owned vendors collect the fines, limit a driver's ability to challenge the tickets and therefore deny drivers their right to due process.

County Judge Kurt Hitzemann decided he wants to hear from the State Attorney's Office before dismiss the citation.

Hitzemann agreed with the Peyton Hyslop saying the ticket was issued under state statute, meaning the city had no relevant legal standing.

Carral received his ticket for driving his 2005 Lexus through a red light at U.S. 41 and Wilcox Road on May 23.

Police issued more than 3,200 tickets since the start of the program and no driver has challenged them in court.

Hitzemann allowed the State Attorney's Office 20 days to file a legal brief. Hyslop will then be allowed time to file a response.
