He was convicted of manslaughter in the death of his neighbor last November, but Trevor Dooley is being allowed to leave jail and go home while a judge considers his appeal.

Dooley, 72, was released from the Orient Road Jail around 4:30 p.m. He had nothing to say as he limped slowly out of jail.

On Friday, Circuit Judge Ashley Moody granted Dooley's request to be released on $100,000 bail while appealing his conviction in the shooting death of David James, 41, at a Valrico park.

Dooley has no prior criminal record and hasn't missed a court date.

Attorney Kevin Hayslett said its unusual circumstances.

“You've got a tragic case. You've got a tragic death but in this case you also have a sympathetic defendant, whose 72 years old. His prior record is none. I don't think he poses any threat and I think that's what the judge was looking at," Hayslett said.

Authorities said Dooley and James, 41, were arguing about a skateboarder using a neighborhood basketball court in September 2010.

Under the conditions of his release, Dooley will have to wear a GPS monitor. He'll have to stay at his family's new home in Hernando County and Dooley won’t be able to leave Hernando unless he needs to talk with his lawyer or go to court. 

Hayslett said Dooley could be free on bond for four to eight months as the appeal process gets underway.

Dooley came to the park and told a skateboarder to leave, and James defended the skateboarder, according to officials. James and Dooley argued and, after the fight escalated, an armed Dooley ended up shooting James.

Dooley said during the trial he only pulled out his gun after James grabbed him by the throat and pulled him to the ground. James was shot and died in front of his then 8-year-old daughter.

The jury rejected Dooley's self-defense argument.

Dooley's attorney, Ronald Tulin, has said the self-defense claim under Florida's "Stand Your Ground" law will be part of Dooley's appeal.

As a condition of his bail, Dooley will not be allowed to leave Hernando County except to attend court proceedings or meet with his attorney.
