Casey Anthony has claimed another small win in bankruptcy court.

A judge granted part of her request to throw out charges brought against her by a non-profit that helped search for her daughter, Caylee.

Texas Equusearch is asking for damages saying the company spent $100,000 searching for the toddler---when the entire time Anthony knew she was dead.

But a judge found that the company will have to show that Anthony in some way benefited from that money.

“This is a volunteer organization, all of the people who participated as well as the Texas Equusearch entity never anticipated getting paid, they volunteered,” said David Schrader, Anthony's attorney. “This wasn't a situation where if we find Caylee we get paid."

Texas Equusearch will now have just 21 days to re-file their claim. If a judge finds in the company's favor, Anthony will go to trial.
