A judge has ruled that the pill given by a Tampa man to his former girlfriend caused her to have a miscarriage.

John Andrew Welden, 29, is accused of giving a pill, Cytotec, to Remee Jo Lee, 27, that caused her to miscarry when she was seven weeks pregnant.

Welden had taken a plea deal in the case, pleading guilty to product tampering and mail fraud. However, his attorneys were trying to prove to U.S. District Judge Richard A. Lazzara that Cytotec could not alone have caused her miscarriage.

On Thursday, medical experts from both sides testified. The day before, prosecutors brought in two doctors who said that even a low dosage of the drug that Lee took could terminate a pregnancy.

Lazzara made his ruling Friday, which means the plea deal stands. Attorneys for both sides jointly recommended a sentence of 13 years and eight months, but Lazzara will have the final say as to how much time Welden spends in prison.

“I think that he was hoping for something different today,” said Todd Foster, Welden’s attorney when asked how his client was holding up. “But as I explained to him, where we are today is exactly where we were two weeks, three, four weeks ago.”

Sentencing is scheduled for Jan. 27 at 1:30 p.m.
