The man accused of kidnapping his children and sailing with them to Cuba has been declared insane.

Circuit Judge Chet Tharpe ruled Wednesday that Joshua Hakken is insane and that he will likely be sent to a hospital for treatment before he can stand trial. He said he will make that decision March 4.

Hakken's wife, Sharyn, will go to trial, but her trial has been postponed for now. Tharpe said he plans to examine her psychological reports as well.

The Hakkens were arrested last April after officials said they kidnapped their two young sons from Sharyn Hakken's parents after they lost custody of them. The Hakkens then sailed to Cuba, where they were apprehended and sent back to Florida.

Prosecutors said Joshua Hakken was convinced he was being persecuted by the federal government because he had uncovered a plot to poison Americans with chemicals from airplanes.

The boys, 5-year-old Cole and 3-year-old Chase, are back in the custody of their grandparents.
