The couple accused of horrific animal abuse at their East Manatee shelter will be back in court Wednesday trying to get evidence being used against them suppressed.

Attorneys for Alan and Sheree Napier, owners of Napier's Long Cabin Horse and Animal Sanctuary, appeared in court Tuesday and got a partial ruling from Circuit Judge Charles Roberts. Because the proceedings started later in the day, Roberts continued the hearing until 3:15 p.m. Wednesday, according to the Bradenton Herald.

The shelter, at 20010 State Road 64 E., was raided Feb. 5 by members of multiple law enforcement agencies. Officers confiscated about 300 animals found in deplorable conditions and uncovered the remains of 20 others.

The Napiers were arrested April 17 after an investigation and then a second time June 2 to face additional charges. Alan Napier faces one count of scheming to defraud $50,000, three counts of soliciting to defraud and 15 counts of animal cruelty. Sheree Napier faces 14 counts of animal cruelty, one count of scheming to defraud $50,000 and one count of soliciting to defraud.

Roberts on Tuesday denied part of a motion to suppress evidence obtained from the excavation of a shallow grave containing animal remains. He agreed to suppress evidence from eight additional horses seized at two other Napier properties in the days after the raid, according to the Herald.

On Wednesday, the defense will argue a motion to suppress evidence obtained with the search warrant, the Herald said.
