The Florida Bar filed a formal complaint against three lawyers involved in the trial between Bubba the Love Sponge Clem and Todd “MJ” Schnitt.

Lawyers Robert Adams, Adam Filthaut, and Stephen Diaco were named in the complaint, accused of violating Florida Bar rules during an alleged DUI setup that resulted in a rival lawyer being arrested for DUI.

In January 2013, documents say an aide with the Adams and Diaco Law Firm, Melissa Personius, was drinking at Malio’s in Tampa when she spotted Phil Campbell. Campbell was the lead attorney for Todd Schnitt, the rival in her law firm’s case.

Documents allege Personius contacted the attorneys to let them know Phil Campbell was there. Dozens of text messages and phone calls were exchanged. That’s when, according to the documents, one attorney called in a Tampa Police officer to stake out Campbell when he decided to get in his car.

But when Campbell and Personius were done drinking at Malio’s, the complaint says Campbell insisted he would walk home. Personius insisted she needed him to move her car a few blocks down. Moments after he helped to move her car, the officer swooped in and arrested Campbell for DUI.

The Florida Bar says the three “participated in presenting criminal charges against Campbell solely to obtain an advantage in the civil matter.”

When Campbell was arrested, his trial briefcase was left in Personius’ back seat. She returned it to her bosses at Adams and Diaco, who, the documents allege, waited hours to let opposing council know where the briefcase was.

The Supreme Court of Florida will decide whether to warn, suspend, or disbar the lawyers for their alleged actions. It could take weeks before that happens.

Meanwhile, an FBI investigation into the alleged setup is ongoing.

The officer involved in the DUI investigation against Campbell has since been fired for his conduct.

A spokesperson for Stephen Diaco says the lawyers will be vindicated once all the facts come out. He added, “there was no setup.”
