Bart, better known around the world as "Zombie Cat," has already been through the fight of his life. But a new battle is brewing that could land in court.
That's because the Humane Society of Tampa Bay is refusing to give Bart back to his owner, Ellis Hutson.
The Humane Society's director, Sherry Silk said Hutson should have taken Bart to the hospital when he was hit by a car instead of burying him.
"Very neglectful, I don’t know if its purposeful, but we just are not going to return the cat to him," said Silk.
Silk also added with Bart's extensive injuries, he cannot be an outside cat, or live in a home with a child. Hutson has a small child, and the Hutson's cats spend most of their time outside.
But the Hutson family won't give up without a fight.
"We've had these cats in our lives ever since they were born. All of a sudden they want to jump up and take the cat?" said Hutson.
They Hutsons say they haven't done anything wrong.
"I don’t think it’s right for me to lose my cat because they say I have a child in the house, and the same child has been with the cat throughout the cat’s life," Hutson added.
The Humane Society also questioned a Go Fund Me page that was created to help with the cat's medical care. So far, it has reached over $7,000.
The Humane Society says it picked up the tab for the cat's care because the family didn't have the money, and wonder why the family is raising money when there are no medical expenses.
Hutson says his neighbor created the account because the family was told Bart's care would be picked up only until his surgery, and then after that, they would be on their own.
But, Hutson and his neighbor, who created the page, have placed a link showing people how they can get a refund if they feel they have been defrauded.
