A 27-year-old construction worker was killed Wednesday morning when he was struck and killed by a bulldozer.

According to police, the accident happened on land under construction for a future apartment complex at 10980 Oak Street N.E. in St. Petersburg. 

Police said the driver of a bulldozer backed-up, striking and killing worker Justin Smith, who died at the scene.

Police said there were approximately 20 workers on the site at the time, including his brother.

Smith, of Dade City, was an employee of API Services. The driver was employed by Central Site Development.

The driver was not injured but taken to Tampa General Hospital for precautionary reasons.

No charges will be filed. The Occupational Safety and Health Administration (OSHA) was called and will perform its own investigation.
