Lakeland Police investigators say the man killed Thursday in an officer-involved shooting should have never been released from jail.

David Cuevas, 42, was killed Thursday night after police said he was shot by detectives in front of a Five Guys Burgers and Fries on Socrum Loop Road.

On Friday, investigators taped together several pages of paper with Cuevas’ previous charges to show just how lengthy his rap sheet is. Some of those charges included armed kidnapping, armed sexual battery and a felon with firearm.

But even with all of those charges, David Cuevas was still let out of a Pennsylvania jail on a Polk County warrant.

“He was originally given a $3 million bond," Sgt. Gary Gross said. "And on his first appearance, for some reason we do not know at this point, the judge reduced that $3 million down to $35,000."

Officials with Philadelphia’s District Attorney’s office confirmed that prosecutors asked a judge for a $3 million bond but the judge granted the defense attorneys $35,000 bond request. They released this statement: “Given the facts of the case they felt that the $3 million was the right amount. After looking at what happened we’re extremely disappointed with the judge’s decision.”

Officials at the State Attorney’s Office say they were also shocked by what happened. They said a Florida judge had denied bond but a judge in Pennsylvania went against that. It’s something they say almost never happens, and it threw a wrench in LPD’s plans.

“We were trying to get him back to Florida,” Gross said. “We had already began the paperwork which is what they call a governor’s warrant and that is to secure him and get him back here but prior to getting that completed they allowed him to bond out on that $35,000.”

Things got even more troubling when police say Cuevas sent threatening text messages to his ex-girlfriend, who he’s accused of raping. Police used those same text messages from the victim’s phone to lure Cuevas to Lake Gibson Park.

Cuevas ran from detectives, and investigators say he pulled a gun and shot himself in the leg before being killed by those detectives.

Police said they chose the park next to the Starbucks and Five Guys restaurants because the suspect had been here before with the victim and because there’s only one way in and out.

However, a lot of employees as well as customers are questioning that decision.
