A Riverview man is accused of fatally abusing of a 20-month-old boy.

Jose Adan Lopez, 28, took the boy to Brandon Regional Hospital on March 19. The boy was not responsive and not breathing, according to the Hillsborough County Sheriff's Office.

Deputies said Lopez told them he found the boy unresponsive in his crib after the boy had eaten, and believed the baby had choked on vomit.

Lopez also told them he was the only person caring for the boy that day.

The boy was declared dead on March 24 at Tampa General Hospital.

The medical examiner conducted an autopsy and determined the baby's cause of death to be cranio-cerebral and spinal trauma due to blunt impacts to the head and neck. The manner of death was ruled as homicide.

Deputies said the medical examiner also said the onset of symptoms would have happened within 30 minutes or less from the time of the injury, which they said puts the time of injury within the time period that Lopez was caring for the little boy.

Lopez was taken into custody on April 21 and charged with first-degree murder and aggravated child abuse.
