A Clearwater homeowner shot someone he said was trespassing in his yard Sunday afternoon, deputies said.

The incident happened just before 2 p.m. at a home in the 2000 block of Whitney Drive.

According to the Pinellas County Sheriff's Office, homeowners Wayne and Linda Nundy had returned from running errands when Linda Nundy, 66, looked through her window and saw a man, later identified as Jacob J. Desimone, 28, walking into the garage/barn located in their enclosed backyard.

Wayne Nundy, 69, armed himself with his .40-calibor semi-automatic pistol and went out to the backyard to investigate while Linda Nundy called 911.

Detectives say Nundy went into the garage/barn and walked up a staircase, which is when he saw Desimone on the second floor. Nundy challenged Desimone and told him to get off his property as he walked up to the second floor, detectives said.

Detectives say Desimone came down the staircase and lunged at Nundy, who fired a warning round into the floor. Nundy told detectives he repeatedly ordered Desimone to leave his property, possibly as many as 50 times, and that Desimone stopped several times, faced him and made aggressive movements towards him.

Detectives say this continued until they were back outside, and the two continued to circle each other on the patio near a shallow pool.

Investigators say Desimone lunged toward Nundy several times, and at one point grabbed a metal patio chair and tried to hit Nundy with it. The struggle continued and Desimone once again lunged at him.

That's when detectives say Nundy shot Desimone.

Desimone was transported by ambulance to Bayfront Medical Center for treatment of life-threatening injuries.

Detectives say Desimone had been reported missing and endangered earlier Sunday morning.

No arrests or charges have been filed at this time.

The investigation continues.
