PREVIOUS STORY: A Hillsborough County judge has granted Trevor Dooley bond while he awaits a decision on his manslaughter appeal.

  • Dooley convicted in 2013 of shooting, killing David James
  • Jury sentenced Dooley to eight years in prison
  • Latest appeal centers on what defense attorneys call "flawed jury instructions"

Dooley was convicted of killing David James, 41, after they fought over skateboarding rules on a basketball court in their neighborhood.

Dooley's attorneys argued at the time that it was self-defense. However, a jury found Dooley guilty of manslaughter and sentenced him to 8 years in prison.

This is his second appeal of that conviction. It centers on what his defense attorneys claim were flawed jury instructions.

James's wife, Kanina Eurez, calls the decision to release Dooley "unfair".

"I believe his birthday is coming up in early December, so he'll have another birthday with his family, he'll have Christmas and New Year's. The appeal is expected to take a year so he'll have all of that time with his family, very precious time that was robbed from us," she said.

The James's daughter, Danielle, was eight years old when her father was killed. She saw it happen.

"It's very difficult to have any sympathy for this man when he has shown no remorse at all," said Eurez.

The judge set $100,000 bond for Dooley, and restricted him from traveling outside of Hernando County, where his family now lives. Dooley is also not allowed to have any contact with James's family.
