Police are still investigating a man’s death at a Pinellas Park nursing home.

Wilbert Moten was dehydrated and covered with second-degree burns when he was taken to the hospital Saturday night. He later died from cardiac failure.   

With no known relatives, healthcare proxy Fernando Gutierrez was in charge of making medical decisions for Moten. However, he said staff at Gracewood Rehab and Nursing care never called to tell him Moten was being taken to the hospital.

"It's serious because I have to consent to any emergency treatment and obviously when the patient arrived at the hospital, I was not aware of it until after the fact,” Gutierrez said. “And that disturbed me."

Gutierrez said he has already started the process of relocating his 10 other clients that reside at the facility.

Bay News 9 reached out to the facility for a response, but our call was not returned.

The Florida State Agency of Healthcare Administration released the following statement:

“The Agency is aware of the incident that occurred at Gracewood Rehab and Nursing Care and we’re reviewing the incident to determine appropriate actions within our Agency’s purview. The Agency takes very seriously our responsibility to ensure the health and safety of all patients and to hold those health care facilities who fail to do so accountable to the patients they serve. Each facility will continue to be held to these high standards.”
