A teacher was investigated in Orange County for sending inappropriate texts to students and resigned. She became a teacher in Polk County, where she is now accused of having sex with a teenage student.

The question is, why was Jennifer Fichter hired in Polk County? That question has two school districts pointing fingers.

Fichter, who was teaching at Lakeland's Central Florida Aerospace Academy, was arrested last week. Officials say she admitted to having sex with a 17-year-old student dozens of times, even getting pregnant and having an abortion.

We confirmed the Orange County School District, the Orange County Sheriff's Office and the Department of Children of Families investigated allegations of inappropriate texting against Fichter at Robinswood Middle in 2008.

But no charges were filed, and Fichter resigned in December of 2008 before Orange County Public Schools could fire her.

Polk County's superintendent is reportedly claiming Fichter falsified her job application.

Monday afternoon, Orange County Public Schools released a statement saying its case worker "did not report the case regarding Fichter to the state Department of Education."

But the statement goes on to say that the district "was not contacted by Polk County regarding the employment of Jennifer Fichter. Had the district been contacted, we would have shared Human Resources and Employee Relations investigative documents detailing Fichter's case with OCPS."

In response, Polk County Schools Superintendent Kathryn LeRoy told News 13 in a phone interview that Fichter "falsified her application for employment with us because she left off her application employment in Orange County in '07 and '08."

"There's also a series of questions that are on the application that ask 'Have you ever been investigated?' and she responded, 'No.' We wouldn't have any reason to call Orange County if we didn't know she was employed there," LeRoy added.

LeRoy said she will formally request Fichter be terminated at Tuesday's School Board meeting and believes it will happen. The Department of Education said it will not comment on pending cases.

Fichter remains in the Polk County Jail on $70,000 bond.
