The Palm Bay mother accused of killing two of her children and nearly a third did not appear in a Brevard County court Sunday.

The public defender representing 33-year-old Jessica McCarty waived her right to appear. A judge ordered no bond, but a bond hearing will be set for a later date.

In addition to two murder charges, McCarty is also charged with attempted murder on her 5-month-old son, who remains in critical condition at an Orlando hospital.

Just after 6 p.m. Friday, McCarty called 911 from the home on 1100 block of Kenmore Street NW, saying children at the home were injured or killed.

When officers arrived, they encountered McCarty standing in the front yard with a butcher knife.

“She was not aggressive towards the officers, but she was not compliant either,” said Palm Bay police spokeswoman Yvonne Martinez. “So they had to shoot her with less lethal rounds of bean bags to get her to comply and she finally did. She was taken into custody.”

Police said 7-year-old Laci McCarty and 6-year-old Philip McCarty were discovered unresponsive inside the home. Both died from their injuries at hospitals Friday night.

Their 5-month-old brother, Christopher Swist, was also found unresponsive in the yard. His father discovered the scene and called police shortly after the first 911 call came in.

Autopsies are scheduled for Sunday and a cause of death has not been confirmed.

"We are still trying to verify the sequence of events, how and why they occurred," said Lt. Mario Augello of the Criminal Investigations Division. "This is still a very active criminal investigation and our priority as always is making sure we have the right answers so there can be justice in the deaths and injuries of these innocent children."

A memorial continues to grow outside the family's home for the children.

Neighbors in the area are still trying to make cope and process what happened.

"It's a quiet neighborhood with a lot of kids," said Patti Knobloch, who lives nearby. "I mean, adults do what you want to each other, but kids — you can't process that."

This is not McCarty's first arrest. Deputies said McCarty was arrested in 2013 or for acquiring a controlled substance by fraud. She was also charged with careless driving last month.

The Department of Children and Families was called to the home in 2009 regarding allegations of inadequate supervision.

That investigation was closed and McCarty was referred to and received services from a mental health provider.

DCF is reviewing the handling of this case.

They released the following statement Saturday:

DCF is grieving the loss to the McCarty and Swist families in the midst of this terrible tragedy.  When the lives of innocent children are taken it leaves family, friends and the community with many unanswered questions. The Department is working closely with the Palm Bay Police Department in an effort to determine the circumstances surrounding this incident.

DCF had one prior investigation with the family in 2009 regarding allegations of inadequate supervision. That investigation was closed with findings and the mother was referred and receiving services from a community mental health provider.  There have been no other incidents with DCF involvement since that time.

Due to the serious nature of the allegations, DCF Secretary Mike Carroll has asked for a review of the circumstances leading up to this incident, led by the Assistant Secretary for Child Welfare and the Assistant Secretary for Substance Abuse and Mental Health.
