A judge has denied bond to a Lake Wales man charged with brutally beating and biting a Lake Wales Police officer Monday evening.

The Lake Wales Police department said Officer Colt Black spotted Marcelino Jimenez-Cruz, 41, riding a bicycle along Highway 60 in the dark with no lights. When Black tried to stop Jimenez-Cruz, he took off into a shopping center parking lot, according to the agency.

When Black caught up to Jimenez-Cruz, officials said Jimenez-Cruz attacked the officer and bit him. A witness called 911 as the altercation was happening.

“The suspect was tazed three times and now the officer is on the ground getting attacked,” the caller said. “The guy’s on top of the officer right now.”

As it turns out, Jimenez-Cruz fought with Polk deputies and choked a k-9 officer when they tried to arrest him a year ago. A deputy suffered a broken hand in the incident.

Sheriff Grady Judd said Jimenez-Cruz is an illegal immigrant.

“My question to ICE is, what are you doing?” Judd said Wednesday.

“He’s here illegally and you failed, and as a result a police officer was almost killed,” Judd explained.

The public information officer for the Sheriff’s Office later clarified that remark to Spectrum Bay News 9 and said authorities aren’t sure if ICE was notified.

The spokeswoman said they understand that Jimenez-Cruz is here illegally and they understand that he should be deported.

Lake Wales PD said it would be aggressive with ICE to make sure that Jimenez-Cruz is deported after he faces justice here.

“We are going to do everything we can to get him out of here,” said police spokesman Troy Schultz.

A spokesperson for ICE said he was not familiar with Jimenez Cruz’s background but would check on his status.
