Hillsborough County deputies are investigating a fatal shooting in Apollo Beach.

One person is in custody.

The incident happened around 6 p.m. Thursday at Del Webb, a retirement community, on the 100 block of Silver Falls Drive.

According to preliminary information, a man and his wife were walking their dog "when they were confronted by one of the neighbors in the subdivision. Some type of altercation broke loose and resulted in one man being shot and killed," said Hillsborough County Sheriff’s Office spokesperson Larry McKinnon.

Officials said the man who confronted the couple had a weapon. Deputies won’t say what that weapon was.

The man walking his dog had a gun. Officials said he had a concealed weapons’ permit. During the altercation, that man shot and killed the other man, officials said.

No charges have been filed at this time.

Officials indicated this may be a ‘Stand Your Ground’ case.

“Well, that will certainly be part of the investigation to see what the history of this individual is. We’re going to of course go back to our call history to see how many times we’ve (deputies) been out here, see what his history is,” said McKinnon. “There’s a lot of components in the investigation and once those all come together determination will be made whether this will be a 'Stand Your Ground' self-defense or in fact (the shooter) ends up getting charged with some level of homicide.”

A neighbor who knew the man killed said everyone was in fear of him.

“It was inevitable that something was going to happen. Either he was going to do something to somebody, or somebody was going to protect themselves from him and do something to him,” said Brian Bellew.

Bay News 9 uncovered a lawsuit filed by the Home Owners Association against the man who was killed.

“It was a very uneasy situation and as the months progressed, it just got worse,” Bellew said. “He threatened some other neighbors with bodily harm, he would verbally abuse everyone. He was not in his right mind."

But some other neighbors we spoke with off-camera said that wasn't the case and called the incident a real shame.

Some told us they tried to help (the man who was killed), that he had been without power and water, they say, for quite some time. They said they had taken him to the doctor and that he was down on his luck and had health issues.

The identities of the two men involved have not been released.
