The National Labor Relations Board is taking Starbucks to court for allegations of illegal labor practices as stores across the nation unionize.

The NLRB alleges more than 200 violations of federal labor law in Western New York.

Monday was the first day of the NLRB hearing where Starbucks Workers United shared discovery and witness testimony.

Witness Michelle Eisen of the Starbucks on Elmwood Avenue was the first on the stand.

Eisen shared testimony about an increase in corporate managers visiting and working at the store after the union campaign started last August.

She said corporate also held listening sessions, one of which Eisen recorded on her apple watch.

That piece of evidence was a point of contention for the Starbucks corporate counsel, as they say the transcription does not identify who the speakers are.

The NLRB counsel argued that the witness could identify speakers.

NLRB attorney Jessica Cacaccio said the one-hour recording is one of about 40 others.

Both parties are discussing the best way to view and share that evidence.

The hearing is scheduled to resume Tuesday at 9 a.m.
