Now, he may have a chance to get off death row.

Vicki Robinson was a 49-year-old realtor in the Carrolwood area of Tampa. He daughter Valessa was 15 and dating Davis when the couple plotted to kill her.

Investigators said the couple and a friend, John Whispel stabbed Vicki Robinson and injected her with a bleach-filled syringe on June 27, 1998. Vicki Robinson had objected to Valessa and Davis' relationship.

Vicki Robinson's body was found in a trash can near her home.

The trio was apprehended days later in Texas.

Davis was convicted and given the death penalty. Jurors, however, were split on his sentence and the law now calls for a unanimous decision on the death penalty.

Valessa Robinson was convicted of third-degree murder and served 13 years in prison. Whispel was sentenced to 25 years and is eligble for parole this year.

A new hearing may result in Davis getting life in prison.
